Terms and Conditions

These Terms & Conditions (“Terms”) govern participation in and use of the Surat Escape community, including Surat GC, Surat Girls GC, WhatsApp groups, social-media communities, official meetups, trips, parties, events and other community activities operated, organised, announced or promoted by Surat Escape and/or Mohit Churiwal (“Community Management”).
By joining, remaining in, participating in, posting in, responding to, or otherwise using any Surat Escape community or group, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree with these Terms, you should leave the relevant group/community and discontinue participation.
ABOUT SURAT ESCAPE
Surat Escape is a social and travel community intended to help people connect with other people, discover activities, attend events, participate in trips, meetups, parties, sports activities, social gatherings and other community experiences.
The community may provide spaces where members can meet new people, share meetup ideas, create or participate in activities, conduct polls, invite other members to privately or publicly organised activities, share information about trips and events, interact with other members and participate in activities officially organised by Surat Escape.
Surat Escape is not a guarantee, certification or endorsement of every individual, activity, venue, organiser, service provider or proposal appearing in its community spaces.
MARKETING, PROMOTION AND ADMINISTRATIVE SUPPORT
The marketing, promotional and related digital activities of Surat Escape are handled by Maxtern Media, a registered business/company based in Surat, Gujarat (“Maxtern Media”).
Maxtern Media may provide marketing, advertising, social-media management, promotional communication, website/digital support, creative services and other administrative or promotional services for Surat Escape.
Maxtern Media is a separate service/marketing entity and its involvement in the marketing or promotion of Surat Escape does not make Maxtern Media the organiser, host, operator, guarantor, sponsor or participant in every activity, meetup, trip, party, house party or gathering discussed or conducted by community members.
To the maximum extent permitted by applicable law, Maxtern Media shall not be responsible for unofficial or member-organised activities, member conduct, private interactions, member-to-member transactions, third-party services, transportation, venues, injuries, property loss, disputes, fraud or other matters outside the services expressly undertaken by Maxtern Media.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.
OFFICIAL SURAT ESCAPE ACTIVITIES
An activity shall be considered an “Official Surat Escape Activity” only when it is expressly organised, announced, confirmed or authorised by Surat Escape and/or Mohit Churiwal through an official Surat Escape communication channel.
Examples may include official Surat Escape trips, meetups, parties, house parties, sports activities, community events and other activities expressly announced as official by the Surat Escape team.
MEMBER-ORGANISED / UNOFFICIAL ACTIVITIES
Members may use community groups to propose or discuss their own meetups, outings, trips, parties, sports activities, gatherings or other activities, subject to the community rules.
Any activity that is not expressly organised, authorised or confirmed by Surat Escape and/or Mohit Churiwal shall be considered an Unofficial / Member-Organised Activity.
This includes activities where a member creates a poll; members decide to meet after discussing in the group; a member invites other members to a private gathering; members independently arrange transportation; members independently collect money; members independently book a venue; members create a separate WhatsApp group; members arrange a trip among themselves; members organise a party or house party; members meet after connecting through Surat Escape; or members use the community to find people interested in an activity.
Surat Escape, Mohit Churiwal and Maxtern Media are not the organisers, operators, sponsors, hosts, agents or representatives of such Unofficial / Member-Organised Activities merely because those activities were discussed, discovered, advertised or promoted through a Surat Escape community group or through marketing/promotional services provided by Maxtern Media.
RESPONSIBILITY FOR UNOFFICIAL ACTIVITIES
For any Unofficial / Member-Organised Activity, responsibility for planning, organisation, communication, transportation, venue selection, payments, permissions, safety, conduct and execution rests with the relevant member(s) who organise or participate in that activity.
Surat Escape, Mohit Churiwal and Maxtern Media do not control who attends such activity, what happens during it, where participants go, how participants travel, what participants consume or purchase, how money is collected or spent, whether the venue is safe or suitable, whether permissions have been obtained, whether the organiser accurately represented the activity, whether participants comply with applicable laws, or the conduct of individual participants.
Participation in an Unofficial / Member-Organised Activity is voluntary and undertaken at the participant’s own discretion and responsibility.
NO AGENCY OR REPRESENTATION
Participation in the Surat Escape community does not create an employment relationship, partnership, joint venture, agency, franchise, representative relationship or other legal relationship between Surat Escape, Mohit Churiwal, Maxtern Media and any community member or independent organiser.
A member organising an activity independently does not have authority to represent themselves as an employee, authorised representative, authorised collection agent, official organiser or other representative of Surat Escape, Mohit Churiwal or Maxtern Media unless expressly authorised in writing.
WHATSAPP GROUPS AND MEMBER CONTENT
Surat Escape may operate or administer WhatsApp groups and other community communication channels, including Surat GC and Surat Girls GC.
Members may post messages, polls, photographs, videos, links, event proposals, recommendations and other user-generated content.
Member-generated content represents the views and actions of the individual member who posted it and does not automatically represent the views, approval or endorsement of Surat Escape, Mohit Churiwal or Maxtern Media.
Surat Escape, Mohit Churiwal and Maxtern Media do not guarantee the accuracy, completeness, legality, safety or reliability of information posted by members.
POLLS AND MEETUP PROPOSALS
Members may create polls or propose meetups within permitted community spaces. A poll, invitation or proposal does not constitute an official endorsement by Surat Escape, Mohit Churiwal or Maxtern Media.
Members participating in a poll or responding to an invitation are responsible for independently confirming the organiser’s identity, meeting location, timing, transportation, costs, venue, other attendees, safety arrangements and other relevant details.
The Surat Escape team may remove, restrict or discontinue any poll, proposal, invitation or discussion where it believes doing so is necessary for community safety, compliance, moderation or other legitimate reasons.
PERSONAL INTERACTIONS BETWEEN MEMBERS
Surat Escape provides a community environment for people to meet and interact. Any friendship, relationship, business relationship, personal interaction, romantic interaction, disagreement, transaction or other relationship formed between members is a relationship between those individuals.
Surat Escape, Mohit Churiwal and Maxtern Media are not responsible for the personal decisions, promises, representations or conduct of individual members.
Members should exercise reasonable judgment before meeting someone privately, sharing personal information, sharing an address or financial information, lending or borrowing money, sending money, travelling with someone they have recently met, inviting someone to a private residence, entering a business transaction, or entering a romantic or personal relationship.
NO GUARANTEE OF MEMBER IDENTITY
Although reasonable moderation measures may be used, Surat Escape does not guarantee that every member is exactly who they claim to be.
Members should not assume that another person’s name, age, profession, location, relationship status, social-media profile, photographs, background, financial position or other personal information has been independently verified by Surat Escape, Mohit Churiwal or Maxtern Media.
SAFETY
Personal safety is the responsibility of every participant. Members should make their own assessment before attending any activity and take reasonable precautions appropriate to the circumstances.
For unofficial activities, participants should independently assess the organiser, venue, transportation arrangements and other relevant circumstances.
For official Surat Escape activities, participants are still responsible for following safety instructions and acting responsibly.
Surat Escape may cancel, modify, postpone or restrict an activity where circumstances reasonably require it, including safety concerns, weather, venue issues, logistical problems, legal requirements or other unforeseen circumstances.
TRAVEL AND TRANSPORTATION
Unless expressly stated otherwise, Surat Escape does not guarantee transportation arrangements for member-organised activities.
For unofficial trips or outings, transportation arranged by members is arranged independently by those members.
Participants are responsible for complying with applicable transportation laws and safety requirements.
PARTIES, HOUSE PARTIES AND PRIVATE GATHERINGS
Parties and house parties may involve additional risks and responsibilities.
For an unofficial party or house party, the private host/organiser is responsible for the gathering; Surat Escape is not the host merely because participants met through the community; the host is responsible for the premises and permissions applicable to the gathering; participants are responsible for their own conduct; and participants must comply with applicable laws.
Members must not use the Surat Escape name, logo or identity to falsely represent an unofficial private gathering as an official event.
ALCOHOL, SMOKING, DRUGS AND ILLEGAL ACTIVITIES
Members must comply with applicable laws.
Surat Escape does not authorise, encourage or require members to consume alcohol, tobacco, nicotine products, cannabis, narcotics or any other controlled or prohibited substance.
Illegal possession, sale, distribution, supply or consumption of prohibited substances is not permitted within community activities or communication channels.
Members remain personally responsible for their conduct and compliance with applicable law.
PROHIBITED CONDUCT
Prohibited conduct includes harassment, threats or intimidation, stalking, sexual harassment, unwanted sexual communication, repeated unwanted contact, sharing private photographs without consent, doxxing, impersonation, fraud or scams, financial deception, theft, violence or threats of violence, hate-based abuse, discriminatory harassment, unlawful activities, distribution of illegal substances, non-consensual recording or distribution of intimate content, malicious targeting, repeated unwanted private messaging, spamming, unauthorised advertising, misleading commercial activity, misrepresentation of an unofficial activity as an official Surat Escape event, and conduct that creates a material safety risk.
The Surat Escape team may take appropriate moderation action, including deleting content, restricting participation, removing members or preventing future access.
PRIVATE MESSAGING AND BOUNDARIES
Joining a community does not give any member an automatic right to privately contact another member.
Members must respect boundaries. If someone indicates that they do not wish to communicate, members must respect that decision.
Repeated unwanted messages, harassment or inappropriate approaches may result in removal from the community.
MONEY, PAYMENTS AND MEMBER TRANSACTIONS
Surat Escape, Mohit Churiwal and Maxtern Media are not responsible for money transferred directly between members for unofficial activities. This includes trip contributions, venue payments, food contributions, transportation contributions, event tickets, accommodation payments, deposits, personal loans, purchases, refunds and reimbursements.
Members should independently verify the recipient and purpose of any payment before transferring money.
A member’s request for payment in a community group does not mean that Surat Escape, Mohit Churiwal or Maxtern Media guarantees the legitimacy of the request.
Unless expressly stated otherwise, Surat Escape and Maxtern Media do not act as an escrow service, payment intermediary or guarantor for transactions between members.
SCAMS AND FRAUD
Members must not use the community to deceive or defraud others.
If a member becomes aware of suspected fraud, impersonation, scam activity or other serious misconduct, they should report it to the Surat Escape team as soon as reasonably possible.
The Surat Escape team may take moderation action and, where appropriate, cooperate with lawful requests from competent authorities.
VENUES AND THIRD-PARTY SERVICE PROVIDERS
Activities may involve restaurants, hotels, clubs, travel operators, transport providers, event venues, sports facilities, photographers, caterers and other vendors.
Unless expressly stated otherwise, such third parties operate independently and their services are subject to their own terms, policies and responsibilities.
Surat Escape, Mohit Churiwal and Maxtern Media do not guarantee the performance, availability, quality or safety of every third-party service provider.
ASSUMPTION OF PERSONAL RISK
Participation in social, travel, sporting, recreational or other activities can involve ordinary and unforeseen risks, including accidents, injuries, illness, property loss, transportation incidents, disputes and other risks.
Participants voluntarily decide whether to participate and should consider their own circumstances before doing so.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.
PERSONAL PROPERTY
Participants are responsible for their own belongings. Surat Escape, Mohit Churiwal and Maxtern Media are not responsible for lost, stolen, damaged or misplaced personal property except to the extent liability cannot lawfully be excluded.
PHOTOGRAPHS, VIDEOS AND SOCIAL MEDIA
Official Surat Escape activities may be photographed or recorded for community documentation, promotional and social-media purposes, subject to applicable law and reasonable privacy considerations.
Members must not secretly or improperly record, publish or distribute private, intimate or sensitive material involving another person without appropriate consent.
MEMBER RESPONSIBILITY FOR CONTENT
Members are solely responsible for content they submit, publish, forward or otherwise communicate through community channels.
Members must not post content that violates applicable law, infringes intellectual-property rights, impersonates another person, harasses another person, invades privacy, contains malicious software, facilitates fraud, promotes unlawful activity, contains prohibited sexual or exploitative material, deliberately misleads members or creates a serious safety risk.
MODERATION RIGHTS
To maintain a safe and functional community, Surat Escape may remove messages, delete polls, restrict posts, remove members, restrict participation, reject requests to join, remove links, suspend access, permanently ban members, cancel community activities, change group rules or restrict particular types of activities.
Moderation decisions may be made based on community safety, conduct, complaints, applicable law, group rules or the interests of the community.
Surat Escape is not required to provide advance notice before taking moderation action where immediate action is reasonably necessary.
NO GUARANTEE OF CONTINUOUS AVAILABILITY
Surat Escape does not guarantee uninterrupted availability of WhatsApp groups, social-media pages, websites, community channels, events, trips, meetups or other services or activities.
Activities may be cancelled, postponed, changed or discontinued due to circumstances including weather, venue availability, insufficient participation, operational issues, safety concerns, legal requirements, third-party issues or other unforeseen circumstances.
EXTERNAL LINKS AND THIRD-PARTY CONTENT
Community groups may contain links to websites, social-media profiles, payment pages, booking platforms or other third-party services.
Surat Escape and Maxtern Media do not necessarily endorse or control third-party websites or content merely because a link is posted in a community or promotional channel.
Members should independently verify external links and payment requests before using them.
INTELLECTUAL PROPERTY
The Surat Escape name, branding, logos, graphics, original promotional materials and other proprietary content may belong to Surat Escape, Mohit Churiwal or their respective licensors.
Members may not reproduce, commercially exploit, impersonate or misuse Surat Escape or Maxtern Media branding without appropriate permission.
COMMUNITY NAME AND UNAUTHORISED REPRESENTATION
Members must not create the impression that they officially represent Surat Escape, Mohit Churiwal or Maxtern Media without authorisation.
Members must not collect money claiming to represent Surat Escape or Maxtern Media without authorisation, announce unofficial events as official events, use Surat Escape or Maxtern Media branding to create misleading promotional material, promise refunds on behalf of either entity, represent themselves as staff, or use the name of Mohit Churiwal, Surat Escape or Maxtern Media to obtain money, access or benefits without permission.
COMPLAINTS AND REPORTING
Members may report suspected violations, harassment, fraud, safety concerns or other serious misconduct to the Surat Escape administration.
The administration may review available information and take reasonable action.
Where an issue concerns an unofficial member-organised activity, the administration may provide moderation assistance but does not automatically assume responsibility for resolving the underlying dispute between participants.
Serious incidents should also be reported to the appropriate authorities where legally appropriate.
LIMITATION OF RESPONSIBILITY
To the maximum extent permitted by applicable law, Surat Escape, Mohit Churiwal and Maxtern Media shall not be responsible for losses, damages, injuries, disputes, misconduct, fraud, theft, personal conflicts, property loss, missed plans, transportation incidents, venue issues or other consequences arising from Unofficial / Member-Organised Activities; conduct of independent community members; private interactions between members; transactions between members; third-party services; information supplied by members; activities undertaken voluntarily by participants; or events and circumstances outside the reasonable control of Surat Escape or Maxtern Media.
This limitation applies only to the extent permitted by applicable law and does not attempt to exclude liability that cannot legally be excluded.
OFFICIAL EVENT LIABILITY
For Official Surat Escape Activities, applicable event-specific instructions, ticketing terms, waivers, vendor terms and other conditions may apply in addition to these Terms.
Participants must follow reasonable instructions issued by the Surat Escape team, venue operators, transportation providers and other authorised service providers.
Nothing in these Terms removes rights or protections that cannot legally be waived.
INDEPENDENT DECISION-MAKING
Every member is responsible for deciding whether to participate in an activity.
Before joining any meetup, trip, party or gathering, members should independently consider whether they know the organiser, whether the venue is appropriate, how they will travel, who else will attend, what the activity involves, the costs involved and any relevant safety considerations.
Participation should never be based solely on the assumption that Surat Escape has verified or endorsed an activity.
AGE REQUIREMENTS
Members must comply with any age requirement communicated for a particular community, event or activity.
Where an activity involves age-restricted goods, services, venues or activities, applicable legal age requirements must be followed.
No member may use the community to circumvent an applicable age restriction.
CHANGES TO THESE TERMS
Surat Escape may modify these Terms from time to time to reflect changes in the community, activities, applicable law, technology or operational requirements.
The updated version may be published through an appropriate community channel or website.
Continued participation after updated Terms are communicated may constitute acceptance of the updated Terms to the extent permitted by law.
SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary where legally permissible, and the remaining provisions shall continue to operate to the extent permitted by law.
GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws applicable in India.
Subject to applicable law, disputes concerning Surat Escape, Mohit Churiwal and their officially operated activities/services shall be subject to the jurisdiction of the competent courts having jurisdiction over Surat, Gujarat.
Nothing in these Terms is intended to unlawfully restrict any person’s statutory or legal rights.
ACKNOWLEDGEMENT
By joining or continuing to participate in Surat Escape community spaces, members acknowledge that not every activity discussed in the community is an Official Surat Escape Activity; member-organised activities are the responsibility of the relevant members and participants; a poll or invitation does not constitute an official endorsement; Surat Escape does not guarantee the identity, conduct or intentions of every member; members are responsible for their own decisions and conduct; members should exercise reasonable caution when meeting people they have met online; members must comply with applicable laws and community rules; Surat Escape may moderate or remove members and content where appropriate; Maxtern Media’s marketing/promotional role does not make it responsible for community-member activities; and these Terms do not exclude any liability or legal right that cannot lawfully be excluded.
